Terms and Conditions Arrifana Surf School and Camp
Arrifana Surf School and Camp, (Passeal Animação Turistica Unipessoal Lda, NIF: 505218950) is an official school of surfing that works with certified surf instructors (FPS/ISA).

1. Bookings
By making a booking, the first named person on the booking agrees on behalf of all persons detailed on the booking that:
a) he/she has read these Terms and Conditions and has the authority to and does agree to be bound by them;
b) he/she consents to our use of personal data in accordance with our Privacy Policy and is authorised on behalf of all persons named on the booking to disclose their personal details to us, including where applicable special categories of data (such as information on health conditions or disabilities and dietary requirements);
c) he/she is over 18 years of age and where placing an order for services with age restrictions declares that he/she and all members of the party are of the appropriate age to purchase those services;
d) he/she accepts financial responsibility for payment of the booking on behalf of all persons detailed on the booking.
e) he/she confirms that he/she doesn’t have any symptoms of any kind of illness or virus on the day of his/her lesson and that he/she will wear his/her face mask in the van (before/after surf).
f) he/she confirms that he/she will inform the instructor about all health problems and past injuries before the start of the lesson.

1.1 Cancellations, changes and refunds

1.1.1 Surf Lessons
In case of cancellation, the customer will receive a credit for use in booking lesson services supplied by us. If the lesson is cancelled or stopped by Arrifana Surf School due to bad weather conditions the customer will also receive a credit. The appropriate refunds will be made in the form of credit. Refunds are not made in other forms of payment. To change the date of the lesson, the client should contact us at least 48 hours before the booking
date, during opening hours. See subparagraph 2.3 for all the details concering cancellations, changes and refunds regarding surf lessons.

1.1.2 Accommodation at Surf Camp
To confirm lodging reservations we ask a deposit of 30% of the total reservation. In the event of cancellation, this value is not refunded. You can, however, use this value as a credit toward another reservation as long as the cancellation or amendment is made 20 days prior to the scheduled date of arrival to accommodation. In case of cancellation after payment of the remaining 70% of the total booking, this will be refunded by bank transfer and all costs associated with this transaction are the customer’s responsibility. See subparagraph 3.4 for all the details concering cancellations, changes and refunds regarding surf lessons.

1.1.3 Rentals
In case of cancellation, the customer will receive a credit for use in booking rental services supplied by us. The appropriate refunds will be made in the form of credit. Refunds are not made in other forms of payment. To change the date of the rentals, the client should contact us at least 48 hours before the booking date, during opening hours.See subparagraph 4.3 for all the details concering cancellations, changes and refunds regarding surf lessons.

2. Surf lessons

2.1 Responsibilities
While using our equipment (wetsuit, rash vest and surfboard) the client agrees to use it with care. The Arrifana Surf School assumes no liability for any injury, damage, death, damages, losses or costs incurred by the customer and/or to third parties due to activities, error, negligence, offences, misconduct, omissions, failures, false information or any illegal false information attributable to our company. We include personal accident
insurance in our surf lessons unless considered a case of neglect or misconduct. In cases of neglect or misconduct, the customer will be responsible for costs incurred in the repair or replacement of damaged equipment.

2.2 The following are considered cases of neglect or misconduct:

2.2.1 Use of soft boards outside the white water area. Unless instructed by a qualified instructor.

2.2.2 Use of hard boards in the white water area. Unless instructed by a qualified instructor.
● Walk or sit on the surfboard when upside down (fins faced upward).
● More than one person walking or sitting on the board simultaneously.
● Dragging of surfboard or wetsuit.
● Any damage caused to the equipment intentionally.
● Failure to follow safety procedures and advice given by qualified on duty surf instructor.

2.3 Cancellations, Changes and Refunds:
2.3.1 Cancellations and Changes.
In case of cancellation, the customer will receive a credit for use in booking services supplied by us in the amount of:
● 100% refund if cancellation made during opening hours, 48 hours in advance of the scheduled start of service.
● 50% refund if cancellation made during opening hours, 12 hours in advance of the scheduled start of service.
● 0% if cancellation is not made during opening hours, 12 hours in advance of the scheduled start of service.

In case of cancellation by Arrifana Surf School, due to bad weather conditions, the customer will receive a credit for use in booking services supplied by us in the amount of 100% refund.

2.3.2 Refunds:
Under the conditions of subparagraph 2.3.1, the appropriate Refunds will be made in the form of credit. Refunds are not made in other forms of payment.

2.3.3 Exceptions:
Paragraph 2.3.1 is not valid for surf lessons pertaining to the promotional package “Full Surfer”.

3. Accommodation

3.1 During the period of stay in our accommodation (Arrifamar lote N31º) the customer agrees to care for the house and its equipment using these with care. The Arrifana Surf School assumes no liability for any injury, damage, death, damages, losses or costs incurred by the customer and/or to third parties due to activities, error, negligence, offences, misconduct, omissions, failures, false information or any illegal false information
attributable to our company. In cases of neglect or misconduct, the customer will be responsible for costs incurred in the repair or replacement of damaged equipment.

3.2 The following are considered cases of neglect or misconduct:

3.2.1 Any damage done to the equipment by misuse.

3.2.2 Any damage caused to the equipment intentionally.

3.3 We reserve the right to terminate or not to accept admission.

3.4 Cancellations, Changes and Refunds:

3.4.1 Cancellations and Changes:

4. Equipment rental

4.1 While using our equipment (wetsuit, rash vest and surfboard) the client agrees to use it with care. The Arrifana Surf School assumes no liability for any injury, death, damages, losses or costs incurred by the customer and/or to third parties due to activities, error, negligence, offences, misconduct, omissions, failures or any illegal false information attributable to our company. In the case of negligence or misconduct, the customer will be
responsible for costs incurred in the repair or replacement of damaged material.

4.2 The following are considered cases of neglect or misconduct:

4.2.1 Use of soft boards outside the white water area. Unless instructed by a qualified instructor.

● 50% refund if cancellation made during opening hours, 12 hours in advance of the scheduled start of service.
● 0% if cancellation is not made during opening hours, 12 hours in advance of the scheduled start of service.

4.3.2 Refunds:
Under the conditions of subparagraph 4.3.1, the appropriate Refunds will be made in the form of credit. Refunds are not made in other forms of payment for equipment rental.

5. Protection of Personal Data
The personal data provided will be kept for the time necessary to fulfil the purpose for which they are collected. Once this period is over, we will keep your date fully saved and protected during the required statutory limitation periods. Once the possible actions of each case are prescribed, we will proceed with the suppression of the personal data. Arrifana Surf School and Camp guarantees that it has implemented appropriate security, technical and organizational measures to guarantee and protect the confidentiality, integrity, and availability of the personal data that each user provides. No data will be transferred to third parties except by legal obligation, or in the case, that is necessary to meet your request, in which case you will be informed in advance.

6. Publicity of images
The customer confirms that he/she allows Arrifana Surf School to take pictures/videos before, during and after the lesson. You don’t mind if your image will appear on our website and/or social media.
